GCSAA and over 70 of its affiliated chapters has joined the members of the Pesticide Policy Coalition to officially OPPOSE the Protect America’s Children from Toxic Pesticides Act of 2020 in a formal letter to members of Congress.
These PROPOSED NATIONAL PROHIBITION undermines 70 years of regulatory advancement based on best available science.

Anti-Pesticide Bills Are Being Introduced In The US Congress
About The Golf Course Superintendents Association Of America
GCSAA’s Government Affairs team will be doing direct outreach to members of Congress in the months ahead to talk to them about the importance of the Federal Insecticide, Fungicide, & Rodenticide Act ( FIFRA ), the most important federal environmental law regulating the registration and use of pesticides in the country.
Pesticides are among the most highly-regulated products in the United States through FIFRA, and the US Environmental Protection Agency, with over 600 career employees dedicated to pesticide review, is assigned authority for registering, or re-registering, pesticides under FIFRA which governs the sale, distribution, and use of pesticides.
GCSAA’s Government Affairs team will also be working with GCSAA members on direct outreach to Congress to explain what professional land management entails.

GCSAA Letter Concerning FIFRA
GCSAA members and friends ―
Bills [ I.E. PROPOSED NATIONAL PROHIBITIONS ] have been introduced in Congress that would drastically change the way golf courses are managed by BANNING [ I.E. NATIONALLY PROHIBITING ] , eliminating or restricting many pesticide products superintendents rely on to maintain healthy turfgrass, trees, and ornamental plants.
The safe and responsible use of pesticides and the continued availability of effective products is a top priority for GCSAA and its members.
For decades, the Federal Insecticide, Fungicide, & Rodenticide Act ( FIFRA ) has provided for the federal regulation of pesticide labeling, distribution, sale, and use with stringent safety standards and oversight at its core.
FIFRA’s foundational, science-based safety standards have successfully provided the regulatory certainty golf course superintendents have long relied upon to manage invasive plants and pests on their golf courses.
But now, FIFRA is under attack.
S 4406, introduced by Senator Tom Udall ( D-NM ), and HR 7940, introduced Representative Joe Neguse ( D-CO ), would undermine the science-based standards contained within our nation’s pesticide laws in many ways.
These bills [ I.E. PROPOSED NATIONAL PROHIBITIONS ] would ―
• Immediately BAN [ I.E. NATIONALLY PROHIBIT ] several classes of pesticides, including organophosphates and neonicotinoids.
• BAN any product currently BANNED or otherwise prohibited by Canada, the European Union, or any one country in the European Union.
• Eliminate pesticide PRE-EMPTION LAWS in every state by allowing local governments to restrict pesticide products, thereby creating a patchwork of differing regulations from town to town.
This legislation is NOT likely to pass this Congress, but these bills [ I.E. PROPOSED NATIONAL PROHIBITIONS ] clearly represent a blueprint of how anti-pesticide groups want to amend pesticide laws in 2021 to significantly restrict [ I.E. PROHIBIT ] your access to these products.
Sending a letter now will not only show your opposition to the bill, it will also help prevent the bills [ I.E. PROPOSED NATIONAL PROHIBITIONS ] from gaining traction in the next Congress.

While PCOs [ PEST CONTROL OPERATORS A.K.A. INDOOR EXTERMINATORS ] have been understandably interested in the November 3rd General Election and how the US Congress make-up will change, they also need to keep tabs on PROPOSED PROHIBITIONS, local and state, that impact pesticide use.
That was the message from Mr Dave Tierney, director of government affairs at Bayer CropScience, who shared several regulatory trends the pest control industry will be following in 2020-2021.
Mr Tierney worked in government affairs 15 years ago for Monsanto ( which was purchased by Bayer ) when Monsanto was defending itself against those opposed to GMOs ( genetically modified organisms ).

IPM relies upon green alternative pesticides that are inferior, more hazardous, & will not work. IPM is #@!!% futile nonsense, & can only lead to garbage dump green spaces.
Montgomery County’s officials know nothing about pest control products. Somehow, language was added to the federal Farm Bill that would PROHIBIT local county or town governments from RESTRICTING the use of pesticides ― a BAN-ON-PESTICIDE-BANS.
If this version of the federal Farm Bill passes by the US Senate this fall, all local governments across the United States will LOSE THEIR RIGHT TO BAN [ I.E. PROHIBIT ] pesticides in their communities.
While some people claim that only the federal US Environmental Protection Agency ( US EPA ) should be allowed to BAN [ I.E. PROHIBIT ] pesticides, the reality is that the US EPA has been doing anything but protecting American citizens [ ?!?!?!?! ] , or fulfilling their mandate involving environmental protection [ ?!?!?!?! ] .
Instead, the US EPA has been going in a different direction.
Recently, the US EPA was sued and lost.
As a result, the government agency was forced to BAN [ I.E. PROHIBIT ] the pesticide chlorpyrifos, but why does it take lawsuits for the agency to BAN these toxic [ ?!?! ] substances ?

War On Science ?
In May 2017, the Trump administration began the process of REPLACING the small army of OUTSIDE SCIENCE ADVISERS at the US Environmental Protection Agency [ US EPA ].
In June 2017, 38 additional US EPA SCIENCE ADVISERS were notified that their appointments would NOT BE RENEWED in August.
To President Trump’s critics, this is another manifestation of his administration’s « WAR ON SCIENCE ». [ ?!?! ]
Histrionics aside, the administration’s actions are long overdue.
The most prominent of the US EPA’s myriad boards of OUTSIDE SCIENCE ADVISERS are the Science Advisory Board [ SAB ] and the Clean Air Scientific Advisory Committee [ CASAC ].
Mostly made up of university professors, these boards also frequently draw members from consulting firms and activist groups.
Only RARELY do members have backgrounds in INDUSTRY.
All US EPA boards are governed by the Federal Advisory Committee Act, which requires that they be BALANCED & UN-BIASED.
While the US Environmental Protection Agency is required by law to convene the SAB and CASAC, the agency is NOT bound by law to heed their advice.

War On Coal & Fine-Particles
The US EPA’s Obama-era « WAR ON COAL » rules and its standards for ground-level ozone ― possibly the most expensive US EPA rule ever issued ― depend on the same scientifically UNSUPPORTED NOTION that the FINE-PARTICLES of soot emitted by smoke-stacks and tail-pipes are LETHAL. [ ?!?! ]
The US EPA claims that FINE-PARTICLES kill hundreds of thousands of Americans annually. [ ?!?! ]
The US EPA first considered regulating FINE-PARTICLES in the mid-1990s.
But when the US Environmental Protection Agency [ US EPA ] ran its claims past the Clean Air Scientific Advisory Committee [ CASAC ] in 1996, it concluded that the scientific evidence DID NOT support the agency’s regulatory conclusion.
Ignoring the panel’s advice, the US EPA’s leadership chose to regulate FINE-PARTICLES anyway, and resolved to figure out a way to avoid future troublesome opposition from CASAC.

It has been speculated that PM2.5 particles produce respiratory and cardiovascular illness. Short for Particulate Matter, 2.5 micrometers or less, PM2.5 particles are considered as air pollutants with a diameter of 2.5 micrometers or less, small enough to invade even the smallest airways.

EPA Grantees & Fine-Particles
In 1996, two-thirds of the CASAC panel had NO financial connection to the US EPA.
By the mid-2000s, the US Environmental Protection Agency [ US EPA ] had entirely flipped the composition of the Clean Air Scientific Advisory Committee [ CASAC ] so two-thirds of its members were US EPA GRANTEES.
Lo and behold, CASAC suddenly agreed with the US EPA’s leadership that FINE-PARTICLES in outdoor air KILL. [ ?!?! ]
During the Obama era, the US EPA packed the CASAC panel.
Twenty-four of its 26 members are now US EPA GRANTEES, with some listed as principal investigators on US EPA research grants worth more than 220,000,000-dollars.
Although the scientific case against FINE-PARTICLES has NOT improved since the 1990s, the US EPA has tightened its grip on CASAC.
In effect, US EPA-funded researchers are empowered to review and approve their own work in order to RUBBER-STAMP the US EPA’s regulatory agenda.
This is all done under the guise of « INDEPENDENCE ».
Another « INDEPENDENT » CASAC committee conducted the most recent review of the Obama US EPA’s GROUND-LEVEL OZONE STANDARDS.
Of that panel’s 20 members, 70 per cent were EPA GRANTEES who had hauled in more than 192,000,000-dollars from the US Environmental Protection Agency over the years.
These US EPA panels make decisions by consensus, which has lately been easy enough to achieve considering they are usually chaired by an EPA GRANTEE.

Litigation Against EPA
Would-be reformers have so far had NO LUCK changing the culture at these US EPA advisory committees.
In 2016, the Energy & Environment Legal Institute, where I am a senior fellow, SUED the US Environmental Protection Agency [ EPA ].
We alleged that the CASAC FINE-PARTICLE SUB-COMMITTEE was BIASED ― a clear VIOLATION of the Federal Advisory Committee Act.
We found a plaintiff who had been refused CASAC membership because of his beliefs about FINE-PARTICLES.
Unfortunately, that individual was not willing to take a hostile public stand against the US EPA for fear of professional retribution.
We ultimately withdrew the suit.

Selection Process For Membership On EPA Advisory Boards
The US Environmental Protection Agency’s opaque selection process for membership on its advisory boards has opened the agency to CHARGES OF BIAS.
In 2016, Michael Honeycutt, Chief Toxicologist of the Texas Commission On Environmental Quality, was recommended in 60 of the 83 nominations to the US EPA for CASAC membership.
The US EPA instead selected Donna Kenski of the Lake Michigan Air Directors Consortium.
Ms Kenski received ONLY ONE of the 83 recommendations.
While NO ONE objected to Mr Honeycutt’s nomination, Senator James Inhofe ( R-OK ) lodged an objection to Ms Kenski’s nomination, claiming she had EXHIBITED PARTISANSHIP during an earlier term on the committee.

Conflict-Of-Interest Rules For
US EPA Science Advisers
Congress has also tried to REFORM the US EPA’s science advisory process.
During the three most recent Congresses, the House has passed bills to PROVIDE EXPLICIT CONFLICT-OF-INTEREST RULES for US EPA SCIENCE ADVISERS, including bans on receiving US EPA grants for three years before and after service on an advisory panel.
The bills went nowhere in the Senate, where the threat of a Democrat-led filibuster loomed.
Had they passed, President Obama surely would have vetoed them.
