The Professional Lawn Care and Distribution businesses, as well as Responsible Industry for a Sound Environment ( RISE ) allege that the Montgomery County has OVER-STEPPED ITS AUTHORITY because the state and Environmental Protection Agency already test, regulate, and license pesticides.
The lawsuit, filed on November 21st, 2016, in Montgomery County Circuit Court, noted that the Maryland Attorney General’s Office advised the council that the PROHIBITION is probably PRE-EMPTED BY STATE LAW.

Under the Federal Insecticide, Fungicide and Rodenticide Act ( FIFRA ), states are allowed to develop their own regulations that are more comprehensive and stringent than federal regulations.
State regulatory offices typically license Professional Lawn Care companies and other users of pest control products, certify individual applicators, investigate companies, and enforce laws in conjunction with the EPA and other agencies, according to the National Pesticide Information Center.
