Finance Minister Jim Flaherty is ready to PLAY HARDBALL WITH ENVIRONMENTAL GROUPS [ a.k.a. Anti-Pesticide & Environmental-Terrorist Organizations ] that ABUSE THEIR CHARITABLE STATUS.
Critics of Charity Tax-Exempt Environmental Groups like Sierra Club and Tides Canada have complained these outfits are heavily-financed political arms of their American cousins and are actively ENGAGING IN PARTISAN POLITICAL ACTIVITIES THAT CONTRAVENE FEDERAL LAWS.
The Government of Canada began a REVIEW of some of their activities in 2012, and HAS DECIDED TO TAKE ANOTHER LOOK, which could lead to legislative changes in 2014 that, among other things, could see their CHARITABLE STATUS REVOKED.

Under the law, Charity Tax-Exempt Environmental Groups are PERMITTED TO SPEND ABOUT 10 PER CENT of their resources on NON-PARTISAN POLITICAL ACTIVITIES related to their charity.
In the 2012 Budget, the Government of Canada instructed the Canada Revenue Agency to TAKE A CLOSER LOOK AT HOW MONEY IS SPENT AND WHERE IT COMES FROM.
The ENHANCED REVIEW comes as Charity Tax-Exempt Environmental Groups STEP UP OPPOSITION to oilsands development, the Keystone XL and Northern Gateway pipelines, TransCanada’s west-to-east pipeline, and other projects.

You’re Not Supposed To Be Politically Partisan
If you run a CHARITY in Canada, the rules are pretty simple.
In order to enjoy TAX-EXEMPT STATUS and give out tax-deductible receipts for donations ― which all Canadians subsidize ― YOU’RE NOT SUPPOSED TO BE POLITICALLY PARTISAN.
YOU’RE NOT SUPPOSED TO TELL PEOPLE, directly or indirectly, TO VOTE FOR A PARTICULAR POLITICIAN OR PARTY, or NOT TO VOTE FOR ANOTHER POLITICIAN OR PARTY.
YOU’RE NOT SUPPOSED TO ENGAGE IN PARTISAN ACTIVITIES using money funneled to you from FOREIGN FOUNDATIONS.
You can spend up to 10 PER CENT of your budget on POLITICAL ACTIVITIES ― for example, informing the public about environmental issues ― but NOT ON A PARTISAN BASIS.
That’s why OUR HERO Federal Finance Minister Jim Flaherty, as he prepares the 2014 Budget, is WARNING ENVIRONMENTAL CHARITIES, for the second year in a row, that ―

Everyone has the right to criticize the Government of Canada and to try to persuade others to their point of view.

Illegal Political Interference By David Suzuki
For example, David Suzuki APPEARED IN A CAMPAIGN VIDEO endorsing former Ontario Liberal premier Dalton McGuinty in the 2011 election, while publicly attacking Tory leader Tim Hudak and the Conservatives.
In the 2008 federal election, SUZUKI ENDORSED THEN-LIBERAL LEADER STEPHANE DION, while ATTACKING PRIME MINISTER STEPHEN HARPER, and the late NDP leader Jack Layton, on environmental issues.
THIS IS NON-PARTISAN ?
Suzuki’s response is that he says these things as an individual, not as a representative of his charity, the David Suzuki Foundation, whose board of directors he resigned in 2013 to make the distinction clear.
Wonderful.
But that doesn’t change the fact charities should have to follow the rules of the Canada Revenue Agency, just as all Canadians do.

If a group has CHARITABLE STATUS, then they HAVE TO PLAY BY THE RULES.
Even if you’re on the side of the righteous.
A media report has revealed that MAJOR ENVIRONMENTAL CHARITIES ARE NOW BEING AUDITED BY THE CANADA REVENUE AGENCY.
When a group is granted CHARITABLE STATUS, they MUST ABIDE BY CERTAIN RULES.
One of these rules is that ONLY 10 PER CENT OF A CHARITY’S RESOURCES CAN GO TOWARDS POLITICAL ADVOCACY.
And even then, this CANNOT BE OF A PARTISAN NATURE.
It’s so far confirmed that SEVEN GROUPS ARE UNDER AUDIT, including ―

Sun Media columnist Ezra Levant has previously asked challenging questions about Tides Canada and other advocacy groups.
But others also have questions about whether or not environmental groups are complying with the rules.
Perhaps the Canada Revenue Agency is simply following up on those concerns.
But here’s what Marcel Lauziere, president of Imagine Canada, told the CBC ―
We’re concerned about what appears to be an increase in audits around political activity and in particular around environmental organizations. [ ?!?! ]
There’s a big chill out there with what charities can and cannot do. [ ?!?! ]
Huh ?
Enforcing rules is NOT exactly a big chill.
These groups may cry out that they’re being silenced.
But, HAVING CHARITABLE STATUS IS NOT A RIGHT.
And losing it ― if it comes to that ― does not mean you’re « silenced ».

Environmental Charities Faced With Audits From Canada Revenue Agency
The Canada Revenue Agency is currently CONDUCTING EXTENSIVE AUDITS ON SOME OF CANADA’S MOST PROMINENT ENVIRONMENTAL GROUPS to determine if they comply with guidelines that RESTRICT POLITICAL ADVOCACY.
If Canada Revenue Agency determines that the Environmental Groups exceeded those limits, their CHARITABLE STATUS COULD BE REVOKED, which would effectively shut them down.
Many of the Environmental Groups are among the Conservative government’s fiercest critics.
OUR HERO Federal Finance Minister Jim Flaherty signaled clearly in his budget of 2012 that POLITICAL ACTIVITY of Environmental Groups would be CLOSELY MONITORED and he allocated 8 million dollars to the effort.
The Environmental Groups believe they have been targeted with the goal of silencing their criticism. [ ?!?! ]
The list of groups CBC has now confirmed are undergoing audits reads like a who’s who in the environmental charity world.
They include ―

• Ecology Action Centre ― SHIELD for Canadian Cancer Society
• Environmental Defence
• Equiterre ― SHIELD for David Suzuki Foundation
• Pembina Foundation
• Tides Canada
• West Coast Environmental Law
CBC has confirmed that at least one group, Environmental Defence, has received its report back from Canada Revenue Agency, and they are appealing it.
Sources said their report THREATENED TO REVOKE THEIR CHARITABLE STATUS.
Another group, West Coast Environmental Law, had auditors fly in from Ottawa to enhance the work of the local Canada Revenue Agency team.
One source said the Ottawa Canada Revenue Agency people called themselves « The A Team ».
Most Environmental Groups on this list would not talk on the record, but sources say executive directors of these groups are meeting regularly by phone to discuss a united response to the government.
By law, charities are ALLOWED TO USE ONLY A MAXIMUM OF 10 PER CENT OF THEIR RESOURCES FOR POLITICAL ACTIVITY OR ADVOCACY, but the guidelines are clear that it CANNOT BE PARTISAN ACTIVITY.
That has been interpreted for years to mean that a group can oppose a government policy but cannot back a specific candidate in an election. [ ?!?! ]
The government insists it does not target certain charities, nor does it tell Canada Revenue Agency to do so.
Auditors alone determine whether they investigate a charity.
Environmental Groups are not the only ones who have been audited.
Social justice groups, like Amnesty International Canada, are also currently undergoing an audit about their political activities.

Rules Governing Charities’ Political Activities
According to Canada Revenue Agency ―
Section 149.1 ( 1 ) of the Income Tax Act, RSC, 1985, c. 1 ( 5th Supp. ) provides that a CHARITABLE ORGANIZATION IS REQUIRED TO DEVOTE ALL OF ITS RESOURCES TO CHARITABLE ACTIVITIES.
Section 149.1 ( 6.2 ) provides that a charitable organization MAY DONATE PART OF ITS RESOURCES TO POLITICAL ACTIVITIES, provided that the activities are ancillary and incidental to its charitable activities, and DO NOT INCLUDE THE SUPPORT OF, OR OPPOSITION TO, ANY POLITICAL PARTY OR CANDIDATE.
The application of the Income Tax Act is described in Policy Statements of Canada Revenue Agency, as set out below.

A charity may make the public aware of its position on an issue, even if that position is supported by a candidate or political party, provided ―
• it does not explicitly connect its views to any political party or candidate for public office;
• the issue is connected to its charitable purposes;

A charity engages in POLITICAL ACTIVITY if it ―

• explicitly communicates to the public that the law, policy, or decision of any level of government in Canada or a foreign country should be retained (if retention is being reconsidered by a government), opposed, or changed;
• explicitly indicates in its materials ( whether internal or external ) that the intention of the activity is to incite, or organize to put pressure on, an elected representative or public official to retain, oppose, or change the law, policy, or decision of any level of government in Canada or a foreign country; or
• attempts to sway public opinion on social issues.
While not all attempts to inform public opinion on an issue are political activity, any purpose that suggests convincing or needing people to act in a certain way, and which is contingent upon a change to law or government policy, is a POLITICAL PURPOSE.
