The state of Maine’s municipal prohibitions against conventional pest control products have become DISMAL FAILURES.
Municipalities, particularly along the coast, have been developing fanatжcal-prohibitions under the FALSE-PRETEXTS of protecting their residents from the supposed threat of harm of pest control products. These prohibition-legislations specifically cite FALSE-PRETEXTS such as ― • bees • birth defects • cancer • children • fish • health • leukemia • poisons • pollution • safety • toxicity, and more. Overwhelming scientific evidence clearly demonstrates that pest control products are scientifically-safe, and will NOT cause harm to children, adults, animals, or the environment. Maine’s municipalities have shown that they are incapable of processing overwhelming scientific evidence. Should we trust municipal officials who conveniently ignore scientific evidence ?!?! NO !
The audacity and hypocrisy of Maine’s municipal officials is clearly evident with EXCEPTION STATUSES that they have conveniently inserted into their fanatжcal-prohibitions. In contradiction to the political-precepts and pesticide-hating doctrines of these prohibitions, these municipalities have allowed tens of thousands of INCONSISTENT AND UNFAIR EXCEPTION STATUSES, including ― • agriculture • golf courses • inferior green alternative pesticides • nurseries • repellents • rodenticides • sports fields • timber harvesting, and more.
Moreover, some municipalities have maliciously prevented residents and businesses from using pest control products without first extorting them to pay for PREDATORY-PERMITS. There should be NO #@!!% EXCEPTION STATUSES and NO #@!!% PREDATORY-PERMITS whatsoever.
The best example of the failures and the ridiculousness of EXCEPTION STATUSES can be seen in Scarborough. Because of its fanatжcal-prohibition, Scarborough’s green spaces became pest-infested and dangerous garbage dumps. Ultimately, ineffective green alternative pesaticides and practices were abandoned in favour of a more effective conventional insecticide called Dylox. This was one of many examples proving that organic pesticide-free maintenance DOES NOT WORK ! Consequently, Scarborough’s fanatжcal-prohibition is among Maine’s biggest DISMAL FAILURES !

Maine’s Republican Governor Paul LePage is backing a State Bill that would strip the anti-pesticide regulations of dozens of cities and towns and prevent them from enacting new rules.
This State Bill, LD 1853, is called ―
An Act To Ensure the Safe and Consistent Regulation of Pesticides throughout the State by Providing Exemptions to Municipal Ordinances That Regulate Pesticides ( Governor’s Bill ).
In summary, the 2018 State Bill LD 1853 would STOP a municipality from …
… adopting or continuing to enforce any ordinance or rule regarding the sale or use of pesticides.
This is the third time Republican-led legislation to STOP the ordinances has been introduced in as many years ( in 2016, Republican Representative Jeff Timberlake introduced similar legislation, which didn’t make it out of committee ).
Here is additional text from 2018 State Bill LD 1853 ―
Ordinance applicability. A municipal ordinance specifically regulating the use of pesticides may not apply to :
A person licensed or certified under section 1471-D.
A person licensed or certified under section 1471-D shall maintain accurate records on product use and applications to property, which must be available at any time for audit or inspection by the board; or
A private applicator applying a pesticide, subject to restrictions under a municipal ordinance, when that private applicator is producing an agricultural or horticultural commodity on property owned, leased or rented by the private applicator in accordance with board rules.
2017 State Bill LD 1505
The second time Republican-led legislation attempted legislation that would strip the anti-pesticide regulations was in 2017.
This State Bill, LD 1505, was called ―
An Act To Create Consistency in the Regulation of Pesticides.
Here is text from 2017 State Bill LD 1505 ―
Restrictions on pesticide ordinances.
A municipality may not adopt or enforce any ordinance or rule regulating the sale or use of pesticides, including without limitation ordinances relating to pesticide use limitations, registration, use notification, advertising and marketing, distribution, applicator training and certification, storage, transportation, disposal or product composition or the disclosure of confidential information related to pesticides.
An ordinance regulating the sale or use of pesticides adopted prior to the effective date of this subsection is void.
As used in this subsection, « pesticide » has the same meaning as in Title 22, section 1471-C, subsection 19.

However, the commercial operators are specifically trained in the safe use and hazards of these chemicals and apply them properly and in the minimum amount needed.
But with commercial operators [ a.k.a. professional lawn care businesses ] no longer allowed to use pest control products in some municipalities with ordinances, Ms Rabinowitz theorizes that home-owners ― who aren’t trained in applications ― will ending up using pesticides themselves, increasing the chances of chemicals being used or stored improperly.

Jacob Harvey is the general manager for a franchise of TruGreen lawn care based in Westbrook.
Harvey said his company has about 50 employees at peak season.

[ Harvey pleaded against being ] lumped together with any bad actors.
We have zero financial incentive to over-apply pesticides.
We pass exams set by the state.

Another supporter has been Samoset Golf Course, which has raised concerns over maintaining the resort’s golf facility if Rockland ever banned all pesticides ( in 2014, Rockland voted to restrict pesticide use on town-owned, leased, or managed lands ).
The Farm Bureau has also spoken in support, as well as several anxious vegetable farmers and an apple farmer who use pest control products and want to be sure they can continue to do so.

The thrust of Governor LePage’s proposed 2018 State Bill LD 1853, offering commercial operators [ a.k.a. professional lawn care businesses ] EXCEPTIONS to those local ordinances, seems to stand in direct opposition to one of the defining characteristics of the Maine constitution : the principle of HOME RULE, whereby municipalities have the right to establish their own ordinances.
The authority of HOME RULE was cited in a law that Governor LePage unexpectedly signed in 2017 allowing municipalities to declare themselves food sovereign, that is, able to establish their own rules about selling local foods to each other.
Governor LePage’s spokes-person Ms Julie Rabinowitz said ―
The governor believes in HOME RULE as a general principle but recognizes that it is not the best policy in every instance.
Governor LePage has argued against local changes to the minimum wage, for instance, Ms Rabinowitz said, on the grounds they would cause confusion and enforcement issues.
In the end, the majority of committee members who voted « ought not to pass » on Governor LePage’s 2018 State Bill LD 1853 cited their belief in and support of HOME RULE as the reason.
If this version of the 2018 State Bill LD 1853 dies, will it come back again before Governor LePage hands over the gubernatorial reins to someone else in 2019 ?!?!

In 2004, Maine’s LARGEST town ( size-wise, it’s spread out over 135 square miles ) arbitrarily imposed ANTI-FORESTRY prohibitions against the use of herbicides.
This fanatжcal-prohibition includes AERIAL SPRAYING.
Fanatжcal-prohibitions was imposed under the FALSE-PRETEXT of MOCK-CONCERNS over herbicides sprayed by the J D Irving Company on its forest holdings in the area.
Fanatжcal-prohibitions sprang from a FALSE-SENSE that something wrong was going on in the woods in the 135-square-mile municipality, where the J D Irving company used AERIAL SPRAYING on its clear cuts to suppress sprouting hardwoods it didn’t want in favor of spruce.
« There were so many cancer patients, » remembers Patricia Pelletier, whose son Louis Pelletier led the movement to PROHIBIT herbicides. « You couldn’t pick the berries around town. » [ ?!?! ]
Allagash still allows residents to put herbicide on say, a stump they are trying to get rid of, Louis Pelletier said.
But the ordinance altered the way J D Irving conducts its forestry, he said.
The herbicides the foresters were using were legal, Pelletier said, and supposedly safe. « But I had done some research at the time, » he said. « And it depends on what scientists you ask. The chemicals they were using were basically safe on their own, but there was no testing done when you mixed them. » [ ?!?! ]
Allagash wanted, he said, to « err on the side of caution », and the ordinance passed overwhelmingly. [ ?!?! ]
« The Irving boys didn’t like it too much, » Pelletier said. « But they are still making money, and we’re not getting sprayed. »

EPA, Health Canada, and other science-based national regulatory agencies have clearly demonstrated that pest control products used in the urban landscape are less toxic than aspirin, baking soda, caffeine, cannabis, nicotine, table salt, and Tylenol. Additionally, these products are NO more toxic than ethanol ( an edible beverage constituent in beer, wine, and other intoxicating beverages ), mouthwash ( Listerine ), and vitamin C. These pest control products are scientifically-safe, practically non-toxic, will cause NO harm, WILL NOT cause cancer, and WILL NOT cause irreversible damage if consumed orally. The probable lethal dose for a person ingesting the concentrated form of many of these products is one litre, the volume of an entire milk carton. By comparison, drinking six litres of water, a fluid that is seemingly harmless, can lead to water poisoning or dilutional hyponatremia, which is a potentially fatal disturbance in brain functions. In essence, water is only five times safer than many of these products. Pest control products are scientifically-safe, and WILL NOT cause harm to people, animals, or the environment.

An Ogunquit pesticide ban will make its green spaces look so #@!!% ugly, just like other jurisdictions. Without conventional pest control products, residents will now have to get used to green spaces that will become pest-infested and dangerous garbage dumps. Ogunquit residents seem to want to live in #@!!% dangerous and pest-infested urban landscapes that look like garbage dumps. On January 3rd, 2018, in the state of Maine, Portland’s city council approved a reckless and arbitrary prohibition against the use of conventional pest control products used in the urban landscape. This municipal prohibition against will inevitably become a dismal failure in every way possible since it is extremely biased and highly prejudicial. Elected officials voted in favour of fanatжcal-prohibition under the false-assumption that inferior green alternatives can somehow replace conventional pest control products. They will quickly recognize that these alternatives are dismal failures NOT only because of their stunning costs, but also because of their lack of effectiveness. Portland’s fanatжcal-prohibition, and its reliance on inferior green alternatives, will cause uncontrollable pest problems that will lead to the imminent demise of green spaces which will degrade to dangerous pest-infested garbage dumps. Additionally, Portland’s fanatжcal-prohibition has allowed hundreds of exception statuses. Over the course of years, Portland’s prohibition will allow inconsistent and unfair exception statuses, including hundreds of pesticide applications on Hadlock Field, Riverside Golf Course, and five athletic fields on Fox Street, at Deering High School, Deering Oaks Park, and Payson Park. Unfortunately, Portland’s fanatжcal-prohibition has been disgustingly arbitrary in its flagrant discrimination against professional lawn care businesses that have been provided with NO exception status whatsoever, and that face assured destruction. Ultimately, ineffective green alternative pesticides and practices were abandoned in favour of a more effective conventional insecticide called Dylox in 2013. This was one of many examples proving that organic pesticide-free maintenance DOES NOT WORK !
Scarborough’s elected officials included EXCEPTION STATUSES that have conveniently allowed municipal staff to circumvent the fanatжcal-prohibition. There should be NO #@!!% EXCEPTION STATUSES whatsoever ! Otherwise, fanatжcal-prohibitions will continue to be DISMAL FAILURES for municipalities in the state of Maine !
Government officials had said $91,000 had been budgeted for athletic fields maintenance, including $75,000 for turf management. As of early 2012, $91,400 had been spent. Government officials expected spending an ADDITIONAL $12,000 for the spring application of Dylox Insecticide for the control of White Grubs, rendering its green spaces no longer pesticide-free. A number of UNEXPECTED COSTS, such as $8,800 for ADDITIONAL White Grub treatments with Dylox at Wiley Recreation Facility and Scarborough Middle School fields, also drove up the costs.
Chip-Charles Osborne was the incompetent consultant and anti-pesticide lunatжc hired by Scarborough to implement organic pesticide-free maintenance that DOES NOT WORK. Osborne’s usual fee for concocting his usual worthless organic strategy is $36,000.
In Scarborough, Maine, the stunningly exorbitant costs continue to rise and rise and rise. In 2012, the first full fiscal year with the organics approach, the town spent $121,578 for turf management. In fiscal year 2013, the figure rose to $137,920 and by 2015 was $159,207.

South Portland made history in 2016 by becoming the LARGEST community in Maine to enact [ fanatжcal-prohibition against conventional and ] synthetic pesticides.
The [ fanatжcal-prohibition ] goes into effect for residents May 1.
City-owned properties have NOT used synthetic pesticides for a year.
The city’s sustainability director, Julie Rosenbach, said Tuesday that South Portland has been developing [ pesticide-hating propaganda ] education and outreach about how to comply with the ordinance and how to transition to organic land care [ which DOES NOT WORK ] .
She said the [ pesticide-hating propaganda ] outreach includes materials, informational events, workshops, and demonstrations.
The ordinance prohibits ALL turf, landscape, and outdoor pest management pesticides, except those listed by the U.S. Department of Agriculture as « allowed substances » [ with inferior green alternative pesticides that DO NOT WORK ] .
It [ arbitrarily ] bans most synthetic pesticides [ that are conventional & effective ] , and [ arbitrarily ] allows most organics.
While imposing its arbitrary fanatжcal-prohibition — prohibiting some products but NOT others through EXCEPTION STATUSES — South Portland CANNOT stop the public from realizing that a large quantity of deliberate mis-information and propaganda has been spread about the imaginary danger of conventional pest control products.

Non-synthetic, organic or natural pesticides [ i.e. inferior green alternative pesticides ] are defined as substances derived from mineral, plant or animal matter that does not go through a synthetic process, according to the ordinance.
The [ fanatжcal-prohibition ] also allows chemicals classified as « minimum risk » by the Environmental Protection Agency [ EPA ] under the Federal Insecticide, Fungicide, and Rodenticide Act [ i.e. inferior green alternative pesticides that DO NOT WORK ] .
Consequences for violators WILL NOT be punitive. Violations will be corrected through educational outreach.
The [ fanatжcal-prohibition ] is being phased-in over three years.
City-owned properties had to comply with the law first. Now residents must make the transition. Next to be included in the change will be the GOLF COURSES, South Portland’s municipal and the privately-owned Sable Oaks Golf Club, starting in May 2019.
A WAIVER [ predatory-permits ?!?! ] process will be available for residents and business owners who must apply a pesticide that isn’t allowed under the ordinance. But the WAIVER will only be granted for « situations that pose a threat to public health and safety, or for the control of invasive species that pose a threat to the environment, » according to Rosenbach’s memo.
In April 2018, WAIVER requests from five oil companies, including Sprague, Portland Pipeline, and Gulf Oil, were DENIED by the council. They asked for a WAIVER to use synthetic pesticides [ that are conventional & effective ] until [ ineffective ] organic products can be proven to be as effective. [ ?!?! ]
Vegetation and flammable materials must be kept away from their tanks, they said, and have been routinely cleared using [ conventional & effective herbicides ] that are not allowed under the ordinance. Councillors urged the companies to try [ ineffective ] alternative methods before coming back to the council.
