Company Fined $40,000 For Pesticide Non-compliance
Norfolk County – Sylvite Agri-Services Ltd. was fined $40,000 for failing to apply a pesticide in accordance with the instructions on the label for the pesticide, contrary to the Pesticides Act.
Norfolk County staff had responded to a reported chemical spill in the area. An investigation determined that the pesticide chloropicrin, had been applied adjacent to buildings inhabited by humans. The label for the pesticide states that the product must not be applied adjacent to fields where crops are growing or to buildings inhibited by humans or livestock. People exposed to chloropicrin experience the same symptoms as those exposed to tear gas. Emergency personnel closed roads and assisted with voluntary evacuation of the area. The matter was reported to the Ministry's Spills Action Centre (SAC) and an emergency response was initiated.
The company was fined a total of $40,000 plus victim fine surcharge totaling $10,000 and was given 30 days to pay the fine.
