Overview
History Of Prohibition In Quebec
In the period of 2003 to 2006, the Province of Quebec became the FIRST PROVINCIAL JURISDICTION to IMPOSE PROHIBITION against pest control products used in the Urban Landscape.
Quebec VALIDATED ITS PROHIBITION under the FALSE-PRETEXT that weed control products containing the ingredient 2,4-D were POSSIBLY carcinogenic. [ ?!?! ]
However, it is a little-known fact that Quebec NEVER IMPOSED A TOTAL PROHIBITION AGAINST ALL PEST CONTROL PRODUCTS, and continued to ALLOW several conventional products, until municipalities like Lac-Beauport in 2016 PROHIBITED ALL OF THE REMAINING PRODUCTS.
Those products that were GRANTED AN EXCEPTION STATUS included Acclaim Herbicide, Betasan Herbicide, Deltagard Insecticide, Dicamba Herbicide, Dimension Herbicide, Imidacloprid Insecticide, and Spinosad Insecticide.
Unlike provinces like Ontario and elsewhere, QUEBEC WAS NEVER TRULY PESTICIDE-FREE !
In 2009, in, Dow AgroSciences CHALLENGED Quebec’s PROHIBITION by INITIATING A LEGAL CHALLENGE against the Canadian federal government under the provisions of the North American Free Trade Agreement ( NAFTA ).
The North American Free Trade Agreement, or NAFTA, is an agreement signed by the governments of Canada, Mexico, and the United States, creating a tri-lateral trade block in North America.
On May 25th, 2011, Dow AgroSciences, the manufacturer of the ingredient 2,4-D, SETTLED THE NAFTA CHALLENGE CASE with the Government of Canada.
As part of the SETTLEMENT, a VICTORY for Dow AgroSciences, the Government of Quebec was HUMILIATED into making a STATEMENT saying that …
2,4-D DOES NOT POSE AN UNACCEPTABLE RISK to human health or the environment.
In other words, Quebec COULD NOT VALIDATE ITS PROHIBITION on the basis that ingredients like 2,4-D were POSSIBLY carcinogenic.
In fact, ABSOLUTELY NO regulatory body in the world classifies 2,4-D as a human carcinogen ― 2,4-D is probably the MOST STUDIED and BEST UNDERSTOOD of ANY chemical ― not just pesticide ― in existence.
2,4-D DOES NOT POSE AN UNACCEPTABLE RISK to human health or the environment.
Overall, pest control products used in the Urban Landscape are SCIENTIFICALLY-SAFE, and WILL NOT CAUSE HARM to people and the environment.

Fanatical And Abusive Prohibition Against Pest Control Products AND Fertilizers Challenged In Lac-Beauport
The PROHIBITION adopted by Lac-Beauport in January 2016 to PROHIBIT THE USE OF PEST CONTROL PRODUCTS AND FERTILIZERS ― IS NOT MAKING EVERYONE HAPPY.
Lac-Beauport is a town located in the Quebec City region, with a population of over 7200 people.
The Quebec Association of Ornamental Horticulture Services ( QAOHS l ASHOQ ) DENOUNCED the PROHIBITION it considers « ABUSIVE ».
Under the Lac-Beauport PROHIBITION, residents CANNOT APPLY EITHER FERTILIZER OR PEST CONTROL PRODUCTS on their lawns, EXCEPT under certain conditions and only after obtaining a PERMIT.
In order to IMPOSE this ARBITRARY PROHIBITION, Lac-Beauport has used the PRETEXTS that water-ways and the health of citizens in its territory NEED TO BE SOMEHOW PROTECTED. [ ?!?! ]
Mr Philippe Caissie, of the Quebec Association of Ornamental Horticulture Services ( QAOHS l ASHOQ ), believes that this PROHIBITION WILL BE DIFFICULT TO FOLLOW.
« All products that are PROHIBITED are available over the counter at the local hardware store. So we think that people will maintain their lawns themselves. There is a real risk that some people would be in breach without even knowing it. »
« For us, this is a major problem, for sure », according Mr Philippe Caissie, President of the Quebec Association Of Ornamental Horticulture Services ( QAOHS l ASHOQ ), a trade association that was founded by Mr William H Gathercole and others.
A « reasonable » use of PEST CONTROL PRODUCTS is desirable, Mr Caissie said.
« The lawn needs certain nutrients. In recent years, businesses have the option to use the products without phosphorus or phosphate. And lawns are not provided phosphorus in large quantities, » said Mr Caissie.

The FANATICAL-MAYOR Louise Brunet remains convinced that whatever quantity is used, there is AN [ IMAGINARY ] RISK to the health of Lake Beauport. [ ?!?! ]

According to the FANATICAL-MAYOR ― « These are products that are still dangerous [ ?!?! ] , even if they say that they use very little. PEST CONTROL PRODUCTS are TOTALLY PROHIBITED, but as for FERTILIZERS, we really want to check what they put in their products. »
QAOHS l ASHOQ lawn care businesses will file a petition this evening to the City Council of Lac-Beauport DENOUNCING THE PROHIBITION.
QAOHS l ASHOQ lawn care businesses also want to introduce a MODEL PROHIBITION that would allow certain FERTILIZERS.
The FANATICAL-PROHIBITION in Lac-Beauport does not apply to the gardens or flower beds [ ?!?! ] ― so, it is ARBITRARILY SAFE to touch and hold pesticide-treated flowers and plants, but, it is somehow UNSAFE to play on pesticide-treated lawn. [ REALLY ?!?! ]
While gardening, PEST CONTROL PRODUCTS AND FERTILIZERS should be used more than 15 metres away from a watercourse.
EXCEPTIONS are also provided in the PROHIBITION to get rid of an invasive plant or damaging insects, but a PERMIT must be obtained.

Monsieur Philippe Caissie, de l’Association des services en horticulture ornementale du Québec ( ASHOQ ), croit que INTERDICTION-FANATIQUE sera DIFFICILEMENT APPLICABLE.
« Tous les produits qui sont INTERDITS sont disponibles en vente libre à la quincaillerie du coin. Donc, on pense que les gens vont partir de leur côté pour avoir un gazon bien entretenu. Il y a un risque réel que certaines personnes soient en infraction sans même le savoir. »
« Pour nous c’est un problème majeur, c’est sûr », selon Monsieur Philippe Caissie, président de l’Association des services en horticulture ornementale du Québec ( ASHOQ ), une association commerciale qui a été fondée par Monsieur William H Gathercole et d’autres.
Une utilisation « raisonnable » de produit anti-parasitaires est SOUHAITABLE, selon Monsieur Caissie.
« La pelouse a besoin de certains nutriments. Depuis quelques années, les entreprises [ de l’ASHOQ ] ont la possibilité d’utiliser des produits sans phosphore ou phosphate à l’intérieur. Et la pelouse ne laisse pas passer du phosphore en quantité importante », affirme Monsieur Caissie.

Ils souhaitent aussi présenter un INTERDICTION-type pour que certains ENGRAIS soient PERMIS.
L’INTERDICTION-FANATIQUE du Lac-Beauport ne s’applique pas aux jardins ni aux plate-bandes [ ?!?! ] ― ainsi, il est ARBITRAIREMENT SÉCURITAIRE de toucher et porter des fleurs et des plantes traitées aux pesticides, mais, il est en quelque sorte DANGEREUX de jouer sur une pelouse traitées aux pesticides. Pour le jardinage, les produit anti-parasitaires ET les engrais devront être utilisés à plus de 15 mètres d’un cours d’eau.
Des EXCEPTIONS sont aussi prévues dans l’INTERDICTION pour se débarrasser d’une plante envahissante ou des insectes nuisibles à condition d’obtenir un PERMIS.
