OWEN SOUND – On January 10, 2011, The Corporation of the Municipality of Grey Highlands pleaded guilty to one violation under the Environmental Protection Act for failing to operate a landfill site in accordance with the Certificate of Approval by burning unapproved waste.
The Court heard that the town owns the Artemesia Landfill in Markdale. The Certificate of Approval specifies that only clean wood and brush can be burned at the site and the burn pile must be visible by the site attendants. In November 2009, ministry staff conducted routine inspections of the waste disposal site and observed materials other than clean wood in the burn pile, including a burnt car battery.
Following the laying of charges on October 7, 2010 by the ministry’s Investigations and Enforcement Branch, the town was convicted of one violation under the Environmental Protection Act and was fined $2,500 plus a victim fine surcharge and given 30 days to pay the fine.
