The town of Hudson, Quebec was the first municipality in North America to PROHIBIT lawn and garden pesticides in 1991.
Twenty years later, has much changed ?
What are the by-laws and loop-holes pertaining to Montreal ?
What can stores sell and what is legal to apply to our own home lawns, do golf courses and farms have special permissions ?
Do citizens still want perfectly manicured lawns even if that means using pesticides, or has the dandelion hatred faded over the years ?
According to Peter Paliotti who has owned the Envirolawn lawn care business for 15 years ―
All you see is dandelions.
I can’t lie to customers.
I have to tell them I can control their weeds a little bit but I can’t get rid of them in a month like I used to be able to.
Like many home-owners and landscapers, Paliotti is frustrated with the strict PESTICIDE PROHIBITION we now have in Montreal.
In the industry for 30 years, he said he has LOST UP TO 70 PER CENT OF THE BUSINESS HE ONCE HAD.
In 1991, Hudson, Quebec became the first municipality in North America to PROHIBIT lawn and garden pesticides.
The PROHIBITION was challenged in court and in 2001 the Supreme Court ruled in favour of the Town of Hudson.
After the ruling, many municipalities across Canada followed suit.
In 2004, Montreal adopted a pesticide by-law which ( mostly ) PROHIBITS the use of really toxic pesticides outdoors.
While pesticides have not been PROHIBITED outright in Montreal, use has been limited, and a number of products were removed from store shelves.
There are also a few exceptions to the by-law, which include golf courses and farms.
Six years after the 2004-2006 QUEBEC PROHIBITION, the remaining businesses operating in the Professional Lawn Care Industry LOST UP TO 70 PER CENT OF THE BUSINESS THEY ONCE HAD.
It is INCONGRUOUS to believe that jurisdictions like Ontario will not suffer the same fate by 2015, especially with greater restrictions than Quebec.
By 2015, six years after the 2009 ONTARIO PROHIBITION, the remaining businesses operating in the Professional Lawn Care Industry WILL LOSE UP TO 70 PER CENT OF THE BUSINESS THEY ONCE HAD.

Anti-Pesticide PROHIBITION in the Province of Quebec
On April 3rd, 2004, the Government of Quebec ARBITRARILY IMPOSED the NEEDLESS, SENSELESS, and MALICIOUS PROHIBITION against pest control products used in the Urban Landscape, such as 2,4-D Herbicide.
The legislation was IMPOSED by 2006 despite the fact that the PROHIBITED pest control products were/are HEALTH-CANADA-APPROVED, FEDERALLY-LEGAL, SCIENTIFICALLY-SAFE, PRACTICALLY-NON-TOXIC, and CAUSE NO HARM.

In 2009, Dow AgroSciences sought a REPEAL of Quebec’s Anti-Pesticide PROHIBITION by INITIATING A LEGAL CHALLENGE against the Canadian federal government under the provisions of the North American Free Trade Agreement ( NAFTA ).
On May 25th, 2011, the LEGAL CHALLENGE WAS SETTLED, and the Government of Quebec was HUMILIATED INTO PUBLICLY ADMITING that « 2,4-D DOES NOT POSE AN UNACCEPTABLE RISK to human health or the environment ».
Quebec was the first province to declare weed control products containing 2,4-D as POSSIBLY carcinogenic, which has now been DEEMED AS FALSE.
Dow AgroSciences’s LEGAL CHALLENGE demonstrated that pest control products are SCIENTIFICALLY SAFE and Anti-Pesticide PROHIBITIONS are IRREFUTABLY INVALIDATED.
