U.S. Regulatory Affairs
In the United States, determining regulations for pest control product use is a responsibility shared at the state and national levels.
The U.S. Environmental Protection Agency ( EPA ) regulates pest control products nationally under the authority of the Federal Insecticide, Fungicide and Rodenticide Act ( FIFRA ) and other laws to register pest control products, educate applicators, monitor compliance, and investigate problems.
EPA employs 1,600 expert-scientists such as chemists, engineers, toxicologists, and experts in many other fields of science.
EPA conducts ecological risk assessments to determine what risks are posed by pest control products, and whether changes to the use or proposed use are necessary to protect the environment.
EPA issues registration for a pest control product that ensures that use according to label directions will NOT cause unreasonable harmful effects on health or environment.
EPA ensures that each registered pest control product continues to meet the highest standards of safety to protect human health and the environment.
EPA has several programs to ensure the review of registered pest control products, including re-registration, tolerance re-assessment, registration review, and special review.
In America, EPA has the essential expertise on pest control products.

America’s Pre-Emption Laws
Under the Federal Insecticide, Fungicide and Rodenticide Act ( FIFRA ), states are allowed to develop their own regulations that are more comprehensive and stringent than federal regulations.
State regulatory offices typically license Professional Lawn Care companies and other users of pest control products, certify individual applicators, investigate companies, and enforce laws in conjunction with the EPA and other agencies, according to the National Pesticide Information Center.
The majority of states have legislated pre-emption laws in order to stop U.S. environmental terrжrism.
In general terms, pre-emption refers to the ability of one level of government to over-ride the laws of a lower level.
Pre-emption laws have effectively stopped the possibility of state or municipal prohibitions against pest control products, and even fertilizers, used in the urban landscape and by the agriculture industry.

Anti-pesticide prohibitions in U.S. states are imposed under the pretext of protecting children, when, in fact, children are NOT at risk.
The ultimate goal of anti-pesticide activists is continuing to impose needless prohibition on grounds surrounding schools and day-care centers, and subsequently opening the door to gradual and eventual expansion to total prohibition.
Children across North America, even in those jurisdictions with NO pesticide bans, are all protected since these products are applied at very low doses and represent NO threat to children.

The anti-pesticide-version of IPM demands the elimination of the use of conventional pest control products, while at the same time attempting ( and failing ) to manage damaging pest populations at an acceptable level.
Unfortunately, pesticide-free IPM has been designed to be applicable for the production of agricultural crops, and NOT for the maintenance of urban green spaces.
Overall, pesticide-free IPM is a dismal failure, and a waste of time and money for municipalities.
Pesticide-free IPM DOES NOT control pests of established turf and ornamentals.
Pesticide-free IPM will NEVER achieve the level of total reduction or elimination of destructive pests attained by using conventional pest control products.
Wherever pesticide-free IPM is entirely relied upon for the maintenance of turf and ornamentals, damaging pests may only be slightly suppressed, at the expense of plant growth, safe playing conditions, and appearance.
To compensate for the failure of IPM, municipal officials have often embarked on a ludicrous effort to reduce the expectations for the condition of city-owned urban green spaces.
These officials resort to promoting low-end playing conditions and to accept dangerous garbage dump green spaces.
They validate the imposition of an unacceptable and dangerous life-style choice on hapless tax-payers.
Municipal officials would be better-off validating the risk assessment of conventional pest control products, which indicates that they are scientifically-safe, and, when used properly, will NOT cause harm to people, animals, or the environment.

Furthermore, Madison’s anti-pesticide policy conflicted with Wisconsin state statute [ pre-emption law ], stating that local governments may NOT prohibit the use of, or otherwise regulate, pesticides.

However, a circuit court judge has struck down the Montgomery County’s general pesticide ban in a ruling that is precedent-setting in America.
Why ?!?!
Because a vast majority of states have pre-emption laws to prevent municipalities and counties from crafting their own laws regarding the use of pest control products and fertilizers.
Montgomery County’s proposed prohibition flouted decades of state primacy in ensuring safe and proper pesticide use.
It also undermined the state of Maryland’s system of comprehensive and uniform product approval and regulation.
Moreover, it intended to prohibit products and conduct that have been affirmatively approved and licensed by the state.
The case was brought to a circuit court judge by plaintiffs including county residents, local lawn care businesses, manufacturers, and the trade association Responsible Industry for a Sound Environment ( RISE ).
The judge made it extremely clear that Montgomery County CANNOT override the state government.
The federal and state regulation of pest control products is so comprehensive by both the state and federal governments that there is NOTHING ELSE the county can do with its prohibition.
Montgomery County’s proposed prohibition ended as a dismal failure, just like many other jurisdictions in America !

After prohibition was imposed, Wallingford’s schools were forced to spend exorbitant amounts of money — they were forced to buy over 40,000 dollars’ worth of equipment, and were forced to hire more personnel to pull weeds.
The exorbitant cost of a so-called organic pesticide-free program — with NO conventional pest control products — was significantly more expensive than an Integrated Pest Management ( IPM ) program that allows the use of pest control products as a last resort.
According to David Paul, director of facilities for the city school system, organic green alternative pesticides « just don’t work, and whatever does remotely work is so expensive it’s not conducive to our budgets ».
In Wallingford, green alternative pesticides have been a dismal failure.
Moreover, Wallingford municipal employees were forced to resort to manual labour, and are required to hand-pull weeds, just like cotton-picking niggжrs.
Those who support over-turning the prohibition believe not using pest control products can still create a harmful environment for students.
Actually, children are at risk with prohibition.
Sports fields are over-grown with clovers and dandelions.
Clover also attracts sting and potentially deadly bees.
